Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of Salonifix, including the website, the Salonifix app, booking pages, mobile apps, and related services (the "Services"), operated by Exelogy ("Exelogy", "we", "our", or "us").

By starting a trial, creating an account, or using the Services, you agree to these Terms. If you are accepting them for a business, you confirm you have authority to bind that business, and "you" means the business. If you do not agree, do not use the Services.

2. Eligibility and accounts

You must be at least 18, or the age of majority where you live, and use Salonifix for a business. You are responsible for the accounts you create for your team, the permissions you give them, keeping login details confidential, and all activity under your account. Tell us straight away if you suspect unauthorised use.

3. Free trial

New salons can try Salonifix free for fourteen days on the Popular plan, with every feature switched on and no card required. When the trial ends, you can choose a plan or let the trial lapse. If you take real payments during the trial, that money settles to your account as normal.

If you do not choose a plan, we may delete the trial account and its data after the trial ends.

4. Plans and billing

Plans and prices are listed on our pricing page. Subscriptions are billed in advance, monthly or yearly, in Pakistani rupees for salons in Pakistan and in US dollars elsewhere, and renew automatically until cancelled. There is no setup fee. Prices exclude any taxes that apply, which are added to your bill.

We may change our prices with reasonable notice before your next billing period. Some features, such as marketing campaign messages, use credits that are bought separately.

5. Changing plans and cancelling

Upgrades apply straight away and are prorated. Downgrades take effect at the end of the current billing period. Plans are month to month, and you can cancel from the settings screen at any time; your subscription then runs to the end of the period you have paid for.

Fees already paid are non-refundable, except where the law requires otherwise or we agree in writing.

6. Payment processing

Card payments, deposits, cards on file, and payouts in Salonifix are provided by a third-party payment processor, and using them means also accepting the processor’s terms. Processing fees are charged at cost and shown on every transaction and payout.

You are responsible for the payments you take, including refunds and disputes (chargebacks) from your clients, and for setting and applying your own deposit, cancellation, and no-show policy fairly and lawfully. Salonifix records that a client accepted your policy; it does not decide disputes between you and your clients.

7. Texts, emails, and calls

Salonifix sends appointment reminders and confirmations and, if you choose, marketing campaigns, in your salon’s name. You are responsible for following the laws that apply to those messages where you and your clients are, including getting consent before sending marketing texts and emails, and for the content of messages you write.

Salonifix processes STOP and unsubscribe requests automatically. Do not use workarounds to message people who have opted out.

8. Your data

You own the information you and your clients put into Salonifix ("Customer Data"). You give us permission to host, copy, process, and display Customer Data only as needed to provide, secure, and improve the Services, as described in our Privacy Policy.

You are responsible for having the right to collect and store Customer Data, including health and treatment notes, and for keeping it accurate. You can export your Customer Data at any time. If you leave, ask and we will give you a full export, with no hoops to jump through.

9. Acceptable use

You agree not to:

• use the Services for anything unlawful, deceptive, or harmful, or to send spam;
• upload content you do not have the right to use, or that is abusive or infringing;
• access another salon’s data, or try to get round permissions or security;
• reverse engineer, decompile, or copy the software, except where the law allows;
• interfere with or overload the Services, or access them by automated means except through the interfaces and API we provide; or
• use the Services to build a competing product.

10. Third-party services

Salonifix connects to services such as accounting software, Google Business Profile, website builders, and social platforms. Those services are run by other companies under their own terms, and we are not responsible for them. Connecting one lets Salonifix exchange the data needed for the connection to work.

11. Availability and support

We work to keep Salonifix fast and available, but there may be planned maintenance and occasional interruptions outside our control. We provide support by chat and email; Popular plan customers also get a named onboarding contact. We may improve, change, or retire features over time, and we will give reasonable notice before removing anything significant.

12. Intellectual property and feedback

The Services, including the software, design, text, graphics, and the Salonifix name and logo, belong to Exelogy or our licensors and are protected by intellectual property laws. We give you a limited, non-exclusive, non-transferable right to use the Services under these Terms.

If you send us ideas or feedback, we may use them without any obligation to you.

13. Confidentiality

Each party will protect the other’s confidential information with at least the care it uses for its own, and will only disclose it as needed to perform under these Terms or as required by law.

14. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXELOGY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.

16. Indemnification

You agree to indemnify and hold harmless Exelogy and its officers, employees, and agents from claims, damages, and expenses arising from your use of the Services, your Customer Data, messages you send through Salonifix, or your breach of these Terms.

17. Suspension and termination

You can stop using Salonifix and cancel at any time. We may suspend or end your access if you seriously or repeatedly breach these Terms, do not pay, or put other users or the Services at risk; where we reasonably can, we will warn you first and give you a chance to fix the problem. When your account ends, your right to use the Services stops, and you can still ask us for an export of your data as described in section 8.

18. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law rules, unless the law where you are located requires otherwise.

19. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will update the date at the top and tell salon owners by email or in the app before the changes take effect. Continuing to use the Services after that means you accept the updated Terms.
